Regulation on Coats-of-Arms, Flags and Seals of the Free and Hanseatic City of Hamburg of 21 June 1982

1. Purpose and purview
1.1. For the design and use of coats-of-arms, flags and seals of the Free and Hanseatic City of Hamburg the following regulations apply. Thereby the patterns for the design of coats-of-arms, flags and seals, attached to this regulation, are authoritative.
1.2. The regulation does not apply to churches and religious communities.

2. Coats-of-arms
2.1. The state coat-of-arms is used in the form of the greater, the middle and the lesser arms. The state coat-of-arms can also be used in black-and-white or relief printing, or in other printing approved by the Senate office.
2.2. The admiralty arms are only used in the form of the lesser arms.

3. Flags
3.1. The city flag shows in the center of the red flag cloth the white three-towered castle. (in Hamburg city and state are the same ; editorial note kms)
3.2. The state flag, that is only used by the Senate in its function of head-of-state, shows in the center of the red flag cloth in a rectangular white field the greater state coat-of-arms.
3.3. The admiralty flag, that is only used by the harbour and shipping authorities of the Free and Hanseatic City of Hamburg and by the vessels employed by the city, shows in the center of the red flag cloth the castle on a blue anchor with yellow anchor stock.

6. Flagging
6.1. The buildings and parts of buildings and the flagstaffs, that are used by the offices and other institutions of the Free and Hanseatic City of Hamburg and the legal entities under the supervision of the city, as well as the vessels employed by the Free and Hanseatic City of Hamburg are to be flagged (if equipped for it) without specific order on the following days (general flagging)
on Day of the victims of Nationalsocialism (27 January)
on Labour Day (1 May)
on Overseas Day (7 May)
on Europe Day (9 May)
on the anniversary of the proclamation of the Basic Law, the provisional constitution (23 May)
on the anniversary of the 17 June 1953(edit. note: insurrection of (East-)German people against DDR government and Soviet occupation; kms)
on the anniversary of the 20 July 1944 (edit. note: assassination attempt on Adolf Hitler; kms)
on Remembrance Sunday (2nd sunday before 1st advent).
on the day of election of the European Parliament
on the day of election of the German Parliament
on the day of election of the Hamburg's Parliament
On 27 January the flagging has to be on half-staff.
On Remembrance Sunday the flagging has to be on half-staff.
The public flagstaffs on Town Hall Square (Rathausmarkt) and the townhall are also to be flagged without a special order
on New Year's Day

6.2. Annexes of minor importance, buildings and parts of buildings, that are not suitable for flagging or are primarily used for private purposes, need not be flagged.
6.3. The Senate orders general flagging on other days not mentioned in number 6.1 and limited flagging on special occasions relevant to the Senate. If there is a special occasion relevant only to a Senate office, a public authority or a district office, the senator or the state secretary or the head of the district office can order limited flagging.
6.4. During flagging the state flag is hoisted from the town hall portico, the European flag from the balcony.
6.5. The other buildings and parts of buildings and the flagstaffs as defined by number 6.1 are flagged with the federal flag and the city flag. The federal flag is hoisted at the right-hand side of the flag of the Land — as seen from the building or the installation to the street. If there are three flagstaffs, on the right and left ones each a federal flag is hoisted, on the central one the flag of the Land. If there is only one flagstaff, only the federal flag is hoisted. In cases of doubt the federal flag occupies the precedent place.
6.6. On buildings and parts of buildings primarily used by the harbour and shipping authorities of the Free and Hanseatic City of Hamburg, the admiralty flag is used instead of the city flag
6.7. If justified by occasion other additional flags may be hoisted.

7. Standards and flags on service automobiles and vessels
7.1. The senators and the state secretaries use for representative occasions a standard on their service automobile, on the right-hand side in the direction of motion.
7.2. The standard is a rectangle of three equally wide horizontal stripes in the federal colours, on it in the center, overlapping up to a third each into the black and golden stripe, the Hamburg state flag. The standard has a size of 18/25 cm.
7.3. Representative occasions as defined by number 7.1 are in particular the participation in state ceremonies and state visits.
7.4. The vessels employed by the Free and Hanseatic City of Hamburg fly — if equipped for that — the federal flag at the stern and the admiralty flag at the jack-staff. If there is a senator or state secretary on board, for representative occasions as defined by number 7.3 the state flag for the Senate as defined by number 3.2 is hoisted additionally.

8. Concluding regulations
8.1. This regulations comes into force on 1 July 1982. At the same time the former regulations of the Senate and the Senate office on coats-of-arms, flags and seals of the Free and Hanseatic City of Hamburg are repealed.

There are three strange facts about the 1982 legal prescription:

  1. according to the constitution this legal prescription should be a law and not only a regulation;
  2. it took the Hamburg authorities 30 years to issue such a regulation — from 1952 to 1982;
  3. it is not cited in the official flag book Laitenberger and Bassier 2000 and earlier editions.

1. Zweck und Geltungsbereich
1.1. Für die Gestaltung und Verwendung von Wappen, Flaggen und Siegeln der Freien und Hansestadt Hamburg gelten die nachstehenden Bestimmungen. Dabei sind die dieser Anordnung beigegebenen Muster für die Gestaltung der Wappen, Flaggen und Siegel maßgebend.
1.2. Die Anordnung gilt nicht für die Kirchen und Religionsgesellschaften.

2. Wappen
2.1. Das
Landeswappen wird in der Form des großen, des mittleren und des kleinen Landeswappens verwendet. Das Landeswappen kann auch in Schwarzweiß- oder Prägedruck oder in anderem von der Senatskanzlei gebilligten Druck verwendet werden.
2.2. Das Admiralitätswappen wird nur in der Form des kleinen Wappens verwendet.

3. Flaggen
3.1. Die Landesflagge zeigt in der Mitte des roten Flaggentuches die weiße dreitürmige Burg.
3.2. Die Staatsflagge, die nur vom Senat in seiner Funktion als Staatsoberhaupt geführt wird, zeigt in der Mitte des roten Flaggentuches im rechteckigen weißen Feld das große Landeswappen.
3.3. Die Admiralitätsflagge, die nur von den Hafen- und Schiffahrtsbehörden der Freien und Hansestadt Hamburg und von ihr eingesetzten Wasserfahrzeugen geführt wird, zeigt in der Mitte des roten Flaggentuches die Burg auf einem blauen Anker mit gelbem Ankerstock.

6. Beflaggung
6.1. Die Gebäude und Gebäudeteile und die Flaggenmasten, die von Dienststellen und sonstigen Einrichtungen der Freien und Hansestadt Hamburg und den ihrer Aufsicht unterstehenden juristischen Personen des öffentlichen Rechts benutzt werden, sowie die von der Freien und Hansestadt Hamburg eingesetzten Wasserfahrzeuge sind — wenn sie dazu eingerichtet sind — ohne besondere Anordnung an folgenden Tagen zu beflaggen (allgemeine Beflaggung) am Tag des Gedenkens an die Opfer des Nationalsozialismus (27. Januar)
am Feiertag der Arbeit (1. Mai)
am Überseetag (7. Mai)
am Europatag (9. Mai)
am Jahrestag der Verkündung des Grundgesetzes (23. Mai)
am Jahrestag des 17. Juni 1953
am Jahrestag des 20. Juli 1944
am Volkstrauertag (2. Sonntag vor dem 1. Advent).
am Tag der Wahl zum Europäischen Parlament
am Tag der Wahl zum Deutschen Bundestag
am Tag der Wahl zur Hamburgischen Bürgerschaft
Am 27. Januar ist halbmast zu flaggen.
Am Volkstrauertag ist halbmast zu flaggen.
Die staatlichen Flaggenmasten auf dem Rathausmarkt und das Rathaus sind ohne besondere Anordnung außerdem zu beflaggen:
-am Neujahrstag

6.2. Nebengebäude von untergeordneter Bedeutung, Gebäude und Gebäudeteile, die zur Beflaggung nicht geeignet sind oder vorwiegend privaten Zwecken dienen, brauchen nicht beflaggt zu werden.
6.3. Die allgemeine Beflaggung an anderen als an den in Nummer 6.1. genannten Tagen und die begrenzte Beflaggung aus besonderen Anlässen, die den Senat betreffen, ordnet der Senat an. Liegt ein besonderer Anlass vor, der nur ein Senatsamt, eine Fachbehörde oder ein Bezirksamt betrifft, kann der Senator oder Staatsrat oder der Bezirksamtsleiter die begrenzte Beflaggung anordnen.
6.4. Bei Beflaggung wird aus der Laube des Rathauses die Staatsflagge, vom Balkon die Europaflagge gesetzt.
6.5. Die anderen Gebäude und Gebäudeteile und die Flaggenmasten im Sinne der Nummer 6.1. werden mit der Bundesflagge und der Landesflagge beflaggt. Die Bundesflagge wird — vom Gebäude oder der Anlage aus mit dem Blick zur Straße gesehen — rechts neben der Landesflagge gesetzt.
Sind drei Masten vorhanden, so wird links und rechts je eine Bundesflagge, in der Mitte die Landesflagge gesetzt. Ist nur ein Mast vorhanden, so wird nur die Bundesflagge gesetzt. Im Zweifel gebührt der Bundesflagge der bevorzugte Platz.
6.6. Auf Gebäuden und an Gebäudeteilen, die überwiegend von Hafen- und Schifffahrtsbehörden der Freien und Hansestadt Hamburg benutzt werden, tritt an die Stelle der Landesflagge die Admiralitätsflagge.
6.7. Sofern der Anlass der Beflaggung es rechtfertigt, dürfen außerdem andere Flaggen gesetzt werden.

7. Stander und Flaggen an Dienstkraftwagen und Wasserfahrzeugen
7.1. Die Senatoren und die Staatsräte führen bei repräsentativen Anlässen an ihren Dienstkraftwagen in der Fahrtrichtung rechts einen Stander.
7.2. Der Stander ist ein Rechteck mit drei gleich breiten Längsstreifen in den Bundesfarben, das in der Mitte jedes zu einem Drittel in den schwarzen und goldenen Streifen übergreifend die hamburgische Staatsflagge zeigt. Der Stander ist 18/25 cm groß.
7.3. Repräsentative Anlässe im Sinne der Nummer 7.1 sind insbesondere die Teilnahme an Staatsakten und Staatsbesuchen.
7.4. Die von der Freien und Hansestadt Hamburg eingesetzten Wasserfahrzeuge führen, wenn sie dazu eingerichtet sind, am Heck die Bundesflagge und am Göschstock die Admiralitätsflagge. Befindet sich ein Senator oder Staatsrat an Bord, wird bei repräsentativen Anlässen im Sinne der Nummer 7.3. zusätzlich die Staatsflagge für den Senat nach Nummer 3.2 gesetzt.

8. Schlussvorschriften
8.1. Diese Anordnung tritt am 1. Juli 1982 in Kraft. Zum gleichen Zeitpunkt werden die bisherigen Regelungen des Senats und der Senatskanzler über Wappen, Flaggen und Siegel der Freien und Hansestadt Hamburg aufgehoben.

Additonal Practice not fixed within the Regulations

It is said, that hoisting the Hamburg flag on the public buildings was introduced by decree of the senate from 3 June 1949. Since then the castle should have had the current form.
(editorial note: in a NDR-television series however it could be seen, that the old version of the castle was in use at least until 1955; this is normal, when the money, especially after a lost war, is needed for more important things than flags).
The current form had been fixed finally in an appendix/template to the decree dated 21 June 1982.

Furthermore there is an additional practice being not mentioned within the legislation texts:
1) During the sessions of the parliament of Hamburg (Bürgerschaft) instead of the state flag a vertical city flag is hoisted at the townhall together with the Europe flag.
2) During the reception of guests of Hamburg's government (Senat) instead of the state flag a vertical city flag is hoisted at the townhall together with the flag of the guest.
On both occasions no flags are hoisted at the townhall square.
