The flag, according to the "Statut" of March 31, 2004, is as follows:
"The flag is a rectangle. Ratio of width to length is 5:8.
The placement of colors of the flag is vertical.
From the left side (at the hoist) there are alternating squares of
red and white in the width of 20 cm ( size of the squares 10 cm each).
On the main part, of yellow color, the Arms of Niemcza are placed."
Arms: or a pillarbox gules roofed azure between two oakbranches vert;
in chief an eagle sable with a crescent argent on its breast.
