Introduction

Until 1992, Saxony was the only Land of Germany not having a formal flag law. Only the constitution mentioned the Landesfarben, "Die Landesfarben sind Weiß und Grün" ("The colours of the state are white and green"), Art. 2 (2) of the constitution.

Law on the Coat-of-Arms of the Free State of Saxony of 1991

Gesetz über das Wappen des Freistaates Sachsen Vom 18. November 1991

Der Sächsische Landtag hat am 25. Oktober 1991 das folgende Gesetz beschlossen:

§ 1
(1) Das kleine Wappen des Freistaates Sachsen zeigt im neunmal von Schwarz und Gold geteilten Schild einen schrägrechten grünen Rautenkranz.
(2) Ein großes Staatswappen des Freistaates Sachsen kann durch besonderes Gesetz bestimmt werden.

§ 2
Für die Gestaltung der Wappen sind die Muster maßgebend, die diesem Gesetz als Anlage beigefügt sind. Die farbigen Muster werden im Sächsischen Hauptstaatsarchiv verwahrt.

§ 3
Die zur Durchführung dieses Gesetzes erforderlichen Rechtsverordnungen erläßt die Staatsregierung. Sie kann diese Ermächtigung weiter übertragen.

§ 4
Dieses Gesetz tritt am Tage nach seiner Verkündigung in Kraft.

Das vorstehende Gesetz wird hiermit ausgefertigt und ist zu verkünden.

Law relating to the coat-of-arms of the Free State of Saxony Of 18 November 1991
(Saxon Law and Official Gazette 1991, p. 383-385)

The Saxon State Parliament has passed on 25th October 1991 the following law:

§ 1
(1) The lesser coat-of-arms of the Free State of Saxony shows an escutcheon bendy of nine pieces black and gold, a green rue-crown bendwise.
(2) A greater coat-of-arms of the Free State of Saxony can be determined by a special law.

§ 2
For the rendering of the coat-of-arms the patterns, which are attached to this law as appendix, are authoritative. The coloured patterns are deposited in the Main Public Record Office of Saxony.

§ 3
The regulations necessary for the implementation of this law are issued by the State Government. It can pass on this authority.

§ 4
This law comes into force the day after its proclamation.

The preceding law is executed herewith and is to be proclaimed.

Vom 4. März 1992

Aufgrund von § 3 des Gesetzes über das Wappen des Freistaates Sachsen vom 18. November 1991 (SächsGVBl. S. 383) wird verordnet.

I. Allgemeines
§ 1
(1) Das Wappen des Freistaates Sachsen führen

  1. die Staatsregierung und der Ministerpräsident,
  2. der Präsident sowie die Mitglieder des Landtags,
  3. die Vertretung des Freistaates beim Bund,
  4. alle Behörden und Gerichte des Freistaates,
  5. die Notare des Freistaates, die Ländernotarkasse und die Notarkammer Sachsen.
(2) Der Ministerpräsident entscheidet in Einzelfällen über die Führung des Staatswappens.

§ 2
Das Recht zur Wappenführung umfaßt die Befugnis, das Wappen im Dienstsiegel, im Briefkopf, auf amtlichen Drucksachen und auf Amtsschildern zu verwenden.

§ 3
(1) Es steht jedermann frei, das Wappen zu künstlerischen oder heraldisch-wissenschaftlichen Zwecken zu verwenden.
(2) Jede andere Verwendung, insbesondere kommerzieller Art, bedarf der Genehmigung durch die Staatskanzlei.

IV. Dienstflaggen
§ 7
(1) Die wappenführenden Stellen, mit Ausnahme der Mitglieder des Landtags und der Notare, sind berechtigt, auf der Landesflagge das Wappen zu zeigen (Landesdienstflagge).
(2) Der Ministerpräsident kann anderen Stellen gestatten, die Landesdienstflagge zu zeigen.
(3) Die Landesdienstflagge wird in der Regel an Dienstgebäuden gesetzt, sofern eine Beflaggung angeordnet ist.

V. Weitere Wappen
§ 8
Mit Genehmigung der Staatskanzlei kann Behörden des Freistaates neben dem Führen des Staatswappens das Führen eines weiteren Wappens gestattet werden. Voraussetzung ist, daß regionale oder ethnisch bedeutsame Gründe vorliegen.

VI. Inkrafttreten
§ 9
Diese Verordnung tritt am Tage nach ihrer Verkündigung in Kraft.

Regulation of the Saxon State Government relating to the Usage of the State Coat-of-Arms (WappenVO)
of 4th March 1992

Under § 3 of the Law relating to the coat-of-arms of the Free State of Saxony of 18 November 1991 (Saxon Law and Official Gazette p. 383) it is decreed:

I. General issues
§1
(1) The coat-of-arms of the Free State of Saxony is used by

  1. the State Government and the Minister President
  2. the President and Members of the State Parliament
  3. the representative of the Free State to the Federation
  4. all Agencies and Courts of the Free State
  5. the notaries of the Free State, the state's notary cashier's office and the notary board of Saxony.
(2) In individual cases the Minister President decides upon the usage of the state coat-of-arms.

§ 2
The right to use the coat-of-arms includes the right to use the state coat-of-arms in the official seal, in the letter-head, in official publications and on office plates.

§ 3
(1) Anybody is free to use the coat-of-arms for artistic of heraldic-scientific purposes.
(2) Every other usage, especially of commercial nature, needs approvement by the Office of the Minister President.

IV. Service flags
§ 7
(1) The authorities using the coat-of-arms, with the exception of the Members of the State Parliament and the notaries, are entitled to show the arms on the state's flag (state service flag).
(2) The Minister President can permit other authorities to show the state service flag.
(3) As a rule, the state service flag is hoisted on official buildings, provided that flagging is ordered.

V. Further coats-of-arms
§ 8
With an approval of the Office of the Minister President the use of another coat-of-arms can be allowed to agencies of the Free State. Precondition for this is, that regional or ethnically important causes exist.

VI. Coming into force
§ 9
This regulation comes into force the day after its proclamation.

There have been some slight changes in this regulation in 1995 by the Verordnung der Sächsischen Staatsregierung zur Änderung der Verordnung über die Verwendung des Staatswappens vom 10. Januar 1995 (Sächsisches Gesetz- und Verordnungsblatt 1995, S. 9) i.e. the Regulation of the Saxon State Government on the amendment of the regulation relating to the usage of the state coat-of-arms of 10 January 1995 (Saxon Law and Official Gazette 1995, p. 9). The amended regulation has been republished in the Sächsisches Gesetz- und Verordnungsblatt 1995, S. 98-99 (Saxon Law and Official Gazette 1995, p. 98-99). The only relevant change is in § 8. The first sentence is changed to:

Mit Genehmigung der Staatskanzlei kann Behörden und Gerichten des Freistaates neben dem Führen des Staatswappens das Führen eines weiteren Wappens gestattet werden.
i.e. "With an approval of the Office of the Minister President the use of another coat-of-arms can be allowed to agencies and courts of the Free State."

Regulation on the Flagging of Official Buildings of 1992

vom 3. April 1992

I
1 Bei der Beflaggung der Dienstgebäude des Freistaates ist der in der Anlage abgedruckte Erlaß der Bundesregierung über die Beflaggung der Dienstgebäude des Bundes vom 10. Juli 1991 (BAnz. S. 5313) sinngemäß anzuwenden. Ergänzend zu diesem Erlaß ist auch am Tag der Wahl zum Sächsischen Landtag regelmäßig zu beflaggen.
2 Der Ministerpräsident kann aus besonderen Anlässen an anderen als den regelmäßigen allgemeinen Beflaggungstagen die Beflaggung der Dienstgebäude des Freistaates anordnen.
3.1 Eine Beflaggung außerhalb des Sitzes der Staatsregierung aus örtlichen, nichtpolitischen Anlässen wird am Sitz der Regierungspräsidien durch den Regierungspräsidenten, in den Kreisfreien Städten durch den Oberbürgermeister und im übrigen durch den Landrat angeordnet.
3.2 Die Beflaggung ist bei örtlichen Anlässen auf Fälle zu beschränken, die nach ihrer besonderen Bedeutung eine amtliche Anteilnahme rechtfertigen.
3.3 Die zur Anordnung der Beflaggung nach Nummer 3.1 berechtigten Behördenleiter holen auf dem Dienstweg die Entscheidung der Staatskanzlei ein,

  1. wenn wegen einer örtlichen Veranstaltung politische Art geflaggt werden soll;
  2. wenn zweifelhaft ist, ob die örtliche Beflaggung als Parteinahme in politischen Fragen gedeutet werden könnte.
4 Soll bei Beflaggungen nach den Nummern 2 und 3 ein gleichmäßiges Vorgehen der gesamten öffentlichen Verwaltung erreicht werden, so verständigen, soweit erforderlich, die Oberbürgermeister der Kreisfreien Städte und die Landräte die am Ort und im Landkreis befindlichen Behörden und Dienststellen des Bundes und der Selbstverwaltung.
5 Aus einem Anlaß, der nur einzelne Verwaltungsbereiche berührt, kann das zuständige Ministerium in seinem Geschäftsbereich die Beflaggung anordnen.
6 Wenn beflaggt wird, setzen die Staatsbehörden neben der Landesdienstflagge oder der Landesflagge in der Regel auch die Bundesflagge. Der Bundesflagge gebührt die bevorzugte Stelle.

II
Den beaufsichtigten Körperschaften, Anstalten und Stiftungen des öffentlichen Rechts wird empfohlen, entsprechend zu verfahren und auch die Landesflagge zu setzen.

Administrative Regulation of the Saxon Ministry of the Interior on the Flagging on Official Buildings
of 3rd April 1992

I
1. For the flagging on official buildings of the Free State the Ordinance of the Federal Government on the flagging on official buildings of the Federation of 10 July 1991 (Federal Official Gazette p. 5313), reprinted as appendix, is to be applied analogously. In addition to this ordinance, it has to be regularly flagged on the day of the election of the Saxon State Parliament, too.
2. On special occasions, the Minister President can order the flagging of the official buildings of the Free State, on other days than regular general flagging days.
3.1. A flagging outside the seat of the State Government for local, non-political occasions is ordered at the seat of the district governments by the district president, in the county-free cities by the lord mayor and for the rest by the county president.
3.2. The flagging for local occasions has to be restricted to cases justifying an official participation because of their special importance.
3.3. The heads of the offices, entitled to order flagging according to number 3.1, get the decision from the Minister President's office through official channels,

  1. if it shall be flagged because of a local event of political nature;
  2. if there are doubts, if the local flagging might be interpreted as a partisanship in political questions.
4. If a congruent action of the whole official administration is desired for flaggings after number 2 and 4, the lord mayors of the county-free cities and the county presidents inform —as far as necessary— the agencies and offices of the Federation and of the self-government at the location and in the county.
5. On an occasion concerning only single parts of the administration, the responsable State Ministry can order flagging for its sphere of responsibility.
6. For flagging, the State agencies regularly fly —beside the State service flag or the State flag— also the Federal flag. The Federal flag is entitled to the privileged position.

II
It is recommendable for the supervised institutions, foundations and entities of public law to proceed analogously and to fly the State's flag, too.

4.- Sorb colours and anthem
1) The colours and coat-of-arms of the Sorbs can be used in the Sorb area of settlement alongside with the state colours and coat-of-arms, with equal rights. The Sorb colours are blue-red-white.

Verwaltungsvorschrift der Sächsischen Staatskanzlei über die Flaggen und die Beflaggung der Dienstgebäude im Freistaat Sachsen (VwV Beflaggung)
vom 19. März 2002

I.
Die Verwaltungsvorschrift gilt für die Flaggen und die Beflaggung der Dienstgebäude aller Behörden und Dienststellen des Freistaates Sachsen sowie der Anstalten, Stiftungen und Körperschaften des öffentlichen Rechts, die der Aufsicht des Landes unterstehen.

II.
1. Die Landesflagge besteht aus zwei gleich breiten Querstreifen, oben weiß, unten grün; das Verhältnis der Höhe zur Länge des Fahnentuches ist 3 zu 5.
Die Landesflagge kann auch in Form eines Banners geführt werden. Das Banner besteht aus zwei gleich breiten Längsstreifen, links weiß, rechts grün.

2. Die Dienstflagge der Landesbehörden (Landesdienstflagge) besteht aus der Landesflagge (siehe Nummer 1) zusätzlich mit dem mittig angeordneten sowie in den weißen und den grünen Streifen je zur Hälfte übergreifenden Landeswappen in einfacher Schildform darauf; das Verhältnis der Höhe zur Länge des Flaggentuches ist 3 zu 5.
Wird die Landesdienstflagge in Bannerform verwendet, ist das Landeswappen parallel zu den Längsstreifen, in den weißen und den grünen Teil je zur Hälfte übergreifend, mittig ausgerichtet.

3. Die Muster zu den Nummern 1 und 2 sind in der Anlage 1 wiedergegeben.

III.
1. Dienstgebäude der Landesbehörden können mit der Landesflagge oder mit der Landesdienstflagge beflaggt werden.

2. Bei der Beflaggung der Dienstgebäude des Freistaates ist der in der Anlage 2 abgedruckte Erlaß der Bundesregierung über die Beflaggung der Dienstgebäude des Bundes vom 23. Mai 2000 (BAnz. S. 11621) sinngemäß anzuwenden.
Ergänzend zu diesem Erlaß ist auch am Tag der Wahl zum Sächsischen Landtag regelmäßig zu beflaggen.
Das Dienstgebäude der Staatskanzlei ist ständig zu beflaggen.

3. Der Ministerpräsident kann aus besonderen Anlässen an anderen als den regelmäßigen allgemeinen Beflaggungstagen die Beflaggung der Dienstgebäude des Freistaates anordnen.

4. Eine Beflaggung außerhalb des Sitzes der Staatsregierung aus örtlichen, nichtpolitischen Anlässen wird am Sitz der Regierungspräsidien durch den Regierungspräsidenten, in den Kreisfreien Städten durch den Oberbürgermeister und im übrigen durch den Landrat angeordnet.
Die Beflaggung ist bei örtlichen Anlässen auf Fälle zu beschränken, die nach ihrer besonderen Bedeutung eine amtliche Anteilnahme rechtfertigen.
Die zur Anordnung der Beflaggung nach Absatz 1 berechtigten Behördenleiter holen auf dem Dienstweg die Entscheidung der Staatskanzlei ein, wenn:

  • wegen einer örtlichen Veranstaltung politische Art geflaggt werden soll;
  • zweifelhaft ist, ob die örtliche Beflaggung als Parteinahme in politischen Fragen gedeutet werden könnte.
5. Soll bei Beflaggungen nach den Nummern 3 und 4 ein gleichmäßiges Vorgehen der gesamten öffentlichen Verwaltung erreicht werden, so verständigen —soweit erforderlich— die Oberbürgermeister der Kreisfreien Städte und die Landräte die am Ort und im Landkreis befindlichen Behörden und Dienststellen des Bundes und der Kommunen.

6. Aus einem Anlass, der nur einzelne Verwaltungsbereiche berührt, kann das zuständige Staatsministerium in seinem Geschäftsbereich die Beflaggung anordnen.

7. Sind in einem Dienstgebäude mehrere Behörden oder Dienststellen des Landes untergebracht, so obliegt die Beflaggung der Behörde, die das Gebäude verwaltet.

8. Wenn beflaggt wird, setzen die Staatsbehörden neben der Landesdienstflagge oder der Landesflagge in der Regel auch die Bundesflagge und —sofern die technischen Voraussetzungen gegeben sind— die Europaflagge. Der Europaflagge und der Bundesflagge gebühren die bevorzugten Stellen.

IV.
Die vorstehende Verwaltungsvorschrift tritt am Tag nach der Veröffentlichung im Sächsischen Amtsbaltt in Kraft. Gleichzeitig tritt die Verwaltungsvorschrift des Sächsischen Staatsministeriums des Innern über die Beflaggung der Dienstgebäude vom 3. April 1992 (SächsABl. S. 440), verlängert durch Verwaltungsvorschrift des Sächsischen Staatsministeriums des Innern vom 1. Dezember 1997 (SächsABl. S. 1259), außer Kraft.

Administrative regulation of the Saxon Minister President's office on the flags and the flagging on official buildings in the Free State of Saxony
of 19th March 2002

I.
The administrative regulation is effective for the flags and the flagging of official buildings of all agencies and offices of the Free State of Saxony as well as for the institutions, foundations and entities of public law under the supervision of the State.

II.
1. The
State's flag consists of two horizontal stripes of equal width, at the top white, at the bottom green; the proportion of height to length of the flag cloth is 3 to 5.
The State's flag can be used in the form of the Banner, too. The Banner consists of two vertical stripes of equal width, at the left white, at the right green.

2. The service flag of the State agencies (State service flag) consists of the State's flag (see number 1) with the additional coat-of-arms of the State in a simple shape of the shield, placed in the center and overlapping into the white and green stripes each to the middle; the proportion of height to length of the flag cloth is 3 to 5.
If the State service flag is used in the form of a Banner, the coat-of-arms of the State is placed in the center, parallel to the vertical stripes, overlapping in the white and green part each to the middle.

3. The patterns for numbers 1 and 2 are reproduced in appendix 1.

III.
1. Official buildings of the State's agencies can be flagged with the State's flag or the the State service Flag.

2. For the flagging on official buildings of the Free State the Ordinance of the Federal Government on the flagging on official buildings of the Federation of 23 May 2000 (Federal Official Gazette p. 11621), reprinted as appendix 2, is to be applied analogously. In addition to this ordinance, it has to be regularly flagged on the day of the election of the Saxon State Parliament, too.
The official building of the Minister President's office has to be flagged continuously.

The preceding administrative regulation comes into force the day after its proclamation in the Saxon Official Gazette.
At the same time the administrative regulation of the Saxon Ministry of the Interior on the flagging on official buildings of 3 April 1992 (Saxon Official Gazette p. 440), extended by administrative regulation of the Saxon Ministry of the Interior of 1 December 1997 (Saxon Official Gazette p. 1259), is abolished.

As you may notice, this newest regulation is basically only an extended version of the regulation of 1992. The main difference is, that now not only the whole procedure of flagging —when, where, why, by whom...— is regulated, but for the first time also the flag types are described in some detail. Otherwise it is literally the same as the 1992 regulation.
